D-ARTIST Ownership Pledge

1. Artist Ownership of Artwork

When you upload photographs of your original paintings, sketches, or illustrations to D-ARTIST:

  • You retain full ownership: D-ARTIST does not acquire copyright, title, or commercial rights to your physical artwork or its digital reproductions.
  • Limited Platform License: You grant D-ARTIST only a non-exclusive, revocable, royalty-free license to host, display, thumbnail, and catalog your artwork solely to operate your public portfolio and feature your work on platform galleries.
  • Right to Remove: You can delete or archive your artwork from the Artist Studio at any time. Once removed, your piece will no longer be visible on public gallery feeds.

2. Human Authorship & Authenticity

Copyright protection requires genuine human creativity:

  • Original Creation: You must be the actual author and creator of every piece you publish.
  • Zero Synthetic Generation: In accordance with our Artist Guidelines, AI-generated imagery and synthetic renders are strictly prohibited. You may not claim copyright over AI prompt outputs on D-ARTIST.
  • Physical Signatures: Every original piece must bear your genuine physical hand-written signature on the surface of the work.

3. Prohibitions on Plagiarism & Stolen Content

We strictly forbid any form of intellectual property theft:

  • No Stolen Art: Uploading scans, photographs, or digital captures of another artist's physical artwork without explicit legal authorization is prohibited.
  • No Unlicensed Photo Replicas: Exact pencil or paint copies of copyrighted photographs taken by other photographers without their license or written permission constitute infringement.
  • No Impersonation: Creating accounts under the name of famous, historical, or active artists you do not legally represent will result in an immediate permanent ban.

4. Submitting a Copyright Infringement Notice

If you are a copyright owner or an authorized agent and believe that content hosted on D-ARTIST infringes your copyright, you may submit a formal takedown request:

01 Identify

Identify the Work

Identify the original copyrighted work you claim has been infringed, including evidence of ownership (e.g. your portfolio link, publication date, or registration documentation).

02 Locate

Locate the Infringing Listing

Provide the exact D-ARTIST URL or artwork ID (e.g. dartist.lk/art/XXXXXXXX or the artist profile URL) where the allegedly infringing material appears.

03 Submit

Submit via Report Desk or Email

Submit your notice through our on-platform Report Content Desk (select "Copyright / IP Infringement") or email our legal team directly at support@dartist.lk.

Please include the following in your written notice:

  • Your full legal name, physical or postal address, telephone number, and email address.
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
  • A physical or electronic signature of the copyright owner or authorized representative.

5. Curatorial Action & Repeat Infringer Policy

Upon receiving a valid copyright notice:

  • Expeditious Removal: We will review the evidence and expeditiously remove or disable access to the infringing material.
  • Uploader Notification: The user who posted the content will be notified and provided with the basis of the takedown.
  • Repeat Infringers: D-ARTIST maintains a strict policy of terminating the accounts of users who repeatedly infringe intellectual property rights.
